Domestic Violence – Stalking

The defendant, a 50-year-old single man, was charged with stalking and domestic violence.

He was involved in a love affair with a beautiful younger woman who lived alone with her 7-year-old girl. The couple had relationship issues and argued a lot. After a fight over breaking up, the alleged victim accused the defendant of imprisoning her in a car and frightening her by jamming his fist through the windshield.

The prosecution had a strong case, demonstrating extreme harassment by the defendant. The evidence showed that he had sent her over 70 emails, left telephone messages constantly, and showed up at her home, her work and her running route over a five month period, despite restraining orders and pleas to leave her alone. The enormity and harassing nature of the contacts was overwhelming.

However, the defense successfully demonstrated that the alleged victim lied about several things, and that she was abusing the system to get the defendant out of her life. Bill Nimmo used evidence to prove that the woman had significant mental issues, which prevented her from trusting men and being involved in a long-term, intimate relationship.

The jury found the defendant not guilty of all charges.
