Child Molestation – Forcible Rape

The defendant was charged with forcibly raping a 14-year-old girl. If convicted of this, the defendant would have received several years in prison.

The girl told police that he forced her to have sex three times during the night of the incident. This was going to be a tough case for the defense, as the evidence clearly showed that he had engaged in sexual relations with the alleged victim.

In spite of this, the defense was able to cast doubts on the alleged victim’s story. Bill Nimmo produced evidence that she voluntarily spent recreational time with the defendant the following day, casting doubt on her story of being held captive.

The prosecution ultimately agreed to a plea bargain dismissing the forcible rape charge. The defendant pled to a much lesser charge of statutory rape and received a 200-day local custody sentence.
