Attempted Rape/Sexual Assault – Date Rape

The client was a successful automobile wholesaler who met a beautiful young waitress in a restaurant he frequented. They arranged to go away to Disneyland for a weekend. The first night they went out to dinner and came back to the motel room at the Disneyland Hotel. At 5 in the morning she ran out of the room to the desk clerk, appearing frightened, and reported that he had sexually assaulted her and had attempted to rape her. The client lied to the police about what happened. He claimed that he had not ejaculated and the police found evidence of his semen in the bed.

The client was charged with sexual assault and the case proceeded to the Courts. At the preliminary hearing in Orange County, criminal defense lawyer, Bill Nimmo, was able to effectively cross examine the alleged victim and show that her story was inconsistent with a non consensual sex act. The Orange County District Attorney’s office dismissed the charges shortly after the preliminary hearing.

The defense aggressively argued against this, contending that the injuries were in fact caused by an accidental fall down the stairs. Criminal lawyer, Bill Nimmo utilized extensive expert consultations with an Orange County pediatric neurologist and a pediatric pathologist.

Recognizing the strength of the case being put together by the defense, the prosecution dismissed the case just prior to the preliminary hearing.
